If you are so manga/anime fan you should know that Tobi is just a shell a second body of Madara, Tobi and Zetsu are created by the same jutsu as the sage of six paths used too split the tentails into 9 tailed beasts, How? Because his battle wit Hasjirama obtained him his senju powers and you know when someone has uchiha and senju blood he can activate the rinnegan:)
The rinnegan is his like he told konan and he toke it back from nagato if you open your eyes when watching the anime you know madara is the second sage of six paths and when he supose to die he activated the rinnegan and used the Creation of All Things Jutsu too Create a Wood/Plant clone of him self and kept his body away hidden till the tailed beast are captured makes sense right;) and you see the gedo statue it is the vessel shell of the ten tails:) why could he be the one too use it? Because it is Madara:)
